Gurugram: A Gurugram court on Wednesday sent Kalyan Bainsla and his cousin Lavnish Gurjar to two days of police custody in connection with the hit-and-run case involving a woman biker on Golf Course Road.
Police sought their custody to investigate the circumstances surrounding the crash and recreate the sequence of events at the spot. The court allowed the request, with the next hearing scheduled for September 18.
The incident occurred on September 13 when a Maruti Suzuki Ciaz allegedly followed and struck a woman riding a motorcycle on Golf Course Road. The impact knocked the biker off her vehicle, after which the car allegedly left the area.
Footage of the incident later surfaced online and went viral. Gurugram Police subsequently registered a case at Sector 56 police station after taking suo motu cognisance of the video.
Kalyan Bainsla Arrested In Rajasthan
Police arrested Bainsla in Rajasthan on Tuesday. His cousin Lavnish, who was allegedly travelling in the car at the time, was also arrested. Bainsla, a gym owner and former kabaddi player, was apprehended near Rajgarh in Rajasthan after police traced him following the circulation of the accident footage.
Police have also alleged that Bainsla attempted to escape while in custody by using the excuse of going to the toilet. He reportedly fell during the attempt and sustained injuries before being taken for medical treatment. The white Maruti Suzuki Ciaz allegedly used in the incident has been taken into police custody. Police are also examining the ownership and circumstances under which the vehicle was being used.
Attempt-To-Murder Charge Added
The case was initially registered over allegations of rash driving and endangering the life or safety of others. Following an examination of CCTV footage, police added Section 109 of the Bharatiya Nyaya Sanhita, relating to attempt to murder.
Police are investigating whether the collision was deliberate. Bainsla has reportedly acknowledged that the crash was his fault but has denied intentionally hitting the biker. The accused’s side has claimed that the viral video does not show the complete sequence of events. They have also alleged that there was a confrontation involving the occupants of the car and people at the scene.
Woman Biker Suffers Injuries
The injured biker has been identified as Shivani Chauhan, also known as Sia. She was riding a superbike when the incident occurred.Shivani later recorded her statement before a judicial magistrate under Section 183 of the Bharatiya Nagarik Suraksha Sanhita. She said she was still experiencing pain following the incident.
Police are examining CCTV footage, witness accounts, the vehicle and other available evidence as part of the investigation. A Special Investigation Team has also been formed to probe the case. Police are expected to question other individuals connected to the incident as the investigation progresses.
